This translation is for information only. If there is any difference, the Spanish version prevails.

These terms govern the use of Premzo by the businesses that subscribe to it (the “Client”). Please read them before signing up: by registering, you accept them.

1. Who we are

Premzo is a service of Manuel Ortega Galiano, a self-employed professional trading as Xyvenza. Full identification details (NIF and address) are in the legal notice. Contact: hola@premzo.app.

2. Purpose

Premzo allows the Client to:

  • create digital loyalty cards for its own clients;
  • register its clients, add stamps and redeem rewards from the mobile app;
  • send the card by email so that its clients can add it to Apple Wallet or Google Wallet;
  • manage its team with roles (owner, administrator and employee);
  • export and erase a client's data.

Premzo is aimed only at businesses and professionals. By accepting these terms, you declare that you are acting on behalf of a business and that you have authority to bind it.

3. Sign-up and account

  • To use Premzo you must register with a valid email and verify it.
  • The Client is responsible for keeping its team's passwords confidential and for everything done with its accounts. We recommend turning on two-step verification.
  • The account owner decides who joins the team and with which role.

4. Plans, trial and prices

Prices are shown excluding VAT, because Premzo is aimed at businesses. VAT is added at the time of payment according to the country and the rate in force.

Founder price. Anyone who reserved and confirmed a founder spot before the launch pays, for as long as their subscription stays active without interruption: Basic €5.90/month or €59/year + VAT; Pro €12.90/month or €129/year + VAT. It applies under the founder price conditions.

  • You can try Premzo free for 30 days within the trial limits. When you reach a limit, Premzo does not let you exceed it until you change plan.
  • The subscription is purchased from the mobile app and charged by the app store (App Store or Google Play) with the payment method you have set up there. It renews automatically for the same period, monthly or yearly, unless you cancel it before the renewal.
  • We may change prices with 30 days' notice. The change will apply at the next renewal and, if you do not agree, you can cancel before then. The founder price of a subscription that stays active without interruption does not change.
  • Refunds of payments made in the store must be requested from the store itself, under its own terms.

5. Acceptable use

The Client undertakes to:

  • use Premzo only for its loyalty programme;
  • register only clients who have asked for it and inform them with the privacy notice that Premzo makes available;
  • not enter special category data (for example, health data) or data of children under 14 without the consent of their parents or guardians;
  • not use Premzo to send unsolicited advertising;
  • not attempt to access other businesses' data, overload the service, circumvent the limits or reverse engineer it;
  • comply with data protection law as controller of its clients' data.

We may suspend the account in the event of a serious breach of these rules, giving prior notice except in urgent cases.

6. Data protection

  • For account and team data, Premzo is the controller. Please see the privacy policy.
  • For the data of the Client's clients, the Client is the controller and Premzo is the processor. The data processing agreement (Art. 28 GDPR) applies and forms part of these terms. We will provide it if you ask us at hola@premzo.app.

7. Availability and support

  • We will do what is reasonable to keep Premzo available, but we do not guarantee an uninterrupted service. There may be downtime for maintenance or due to third-party failures (hosting, Apple, Google or email providers).
  • Support is provided by email at hola@premzo.app.
  • We may improve or change features. If we remove an essential feature of the plan you pay for, we will let you know and you will be able to cancel.

8. Intellectual property

  • Premzo, its software, its brand and its design belong to Manuel Ortega Galiano. The Client receives a non-exclusive, non-transferable right of use for the duration of the subscription.
  • The Client retains all rights to its logo, its texts and its data, and authorises us to use them only to provide the service (for example, to show its name on the card).

9. Liability

  • Premzo is not liable for indirect damage or loss of profits.
  • Premzo's total liability to the Client, on any grounds, is limited to the amount the Client has paid for the service in the previous 12 months.
  • These limitations do not apply in cases of wilful misconduct or gross negligence.
  • The Client is responsible for the content it enters and for fulfilling its obligations as controller towards its clients.

10. Term and cancellation

  • The contract lasts for as long as the subscription is active.
  • You can cancel the subscription at any time from the subscription settings of the App Store or Google Play. Cancellation takes effect at the end of the period already paid.
  • Premzo may terminate the contract for serious breach or non-payment, or with 30 days' notice if it stops providing the service.

11. Data at the end of the contract

  • Before closing your account, you can download from the app an export with your clients, their cards and their stamps.
  • After the account is closed, we keep the data for 30 days to allow its recovery or return, and then erase it, except data we must keep by law, which remains blocked.

12. Changes to the terms

We may modify these terms. We will notify you by email or in the app 30 days in advance and, if you do not agree, you can cancel before they take effect.

13. Governing law and jurisdiction

These terms are governed by Spanish law. For any dispute, the parties submit to the courts of Baza (Granada) (Juzgados de Baza), without prejudice to the rights that the law grants to consumers and to any other jurisdiction imposed by law.
